FAST FOOD GIANT McDonald’s won a major victory after it was cleared of causing obesity in children.

A judge threw out a lawsuit that blamed the chain for failing to tell customers that eating too much of its food could be unhealthy.

The plaintiffs included a 14-year-old girl who is 4ft10in tall and weighs more than 14 stone.

US district judge Robert Sweet ruled the plaintiffs could refile some of their claims if they could prove there were dangers from eating Big Macs, fries and Chicken McNuggets which were not commonly known.

He added: ‘If consumers know the potential ill-health effect of eating at McDonald’s, they cannot blame McDonald’s if they, nonetheless, choose to satiate their appetite with a surfeit of supersized McDonald’s products.’

The suit was brought on behalf of overweight children who ate at two McDonald’s restaurants in New York.

The plaintiffs sought unspecified damages, blaming the chain for health problems including diabetes, heart disease, obesity, high blood pressure and cholesterol.

McDonald’s said it provided nutritional information about its food for 30 years and hailed the decision as a victory for common sense. ‘We said from the beginning that this was a frivolous lawsuit,’ a spokesman said. ‘Today’s ruling confirms that fact.’

The judge said he was mindful that the case could have ’spawned thousands of similar “McLawsuits” against all types of restaurants.

He added: ‘The potential for lawsuits is even greater given the numbers of persons who eat food prepared at other restaurants in addition to those serving fast food.’

The case came to light six months to the day since it was first reported – on the same day it was revealed millions of African children faced starvation. Americans spend more than £68billion on fast food a year.
